Feds STILL unable to distinguish art from bioterrorism
Grand jury to convene June 15

HELP URGENTLY NEEDED - SEE BELOW

Three artists have been served subpoenas to appear before a federal
grand jury that will consider bioterrorism charges against a
university professor whose art involves the use of simple biology
equipment.

The subpoenas are the latest installment in a bizarre investigation
in which members of the Joint Terrorism Task Force have mistaken an
art project for a biological weapons laboratory (see end for
background). While most observers have assumed that the Task Force
would realize the absurd error of its initial investigation of Steve
Kurtz, the subpoenas indicate that the feds have instead chosen to
press their "case" against the baffled professor.

Two of the subpoenaed artists--Beatriz da Costa and Steve Barnes--are,
like Kurtz, members of the internationally-acclaimed Critical Art
Ensemble (CAE), an artists' collective that produces artwork to
educate the public about the politics of biotechnology. They were
served the subpoenas by federal agents who tailed them to an art show
at the Massachusetts Museum of Contemporary Art. The third artist,
Paul Vanouse, is, like Kurtz, an art professor at the University at
Buffalo. He has worked with CAE in the past.

The artists involved are at a loss to explain the increasingly bizarre
case. "I have no idea why they're continuing (to investigate)," said
Beatriz da Costa, one of those subpoenaed. "It was shocking that this
investigation was ever launched. That it is continuing is positively
frightening, and shows how vulnerable the PATRIOT Act has made freedom
of speech in this country." Da Costa is an art professor at the
University of California at Irvine.

According to the subpoenas, the FBI is seeking charges under Section
175 of the US Biological Weapons Anti-Terrorism Act of 1989, which has
been expanded by the USA PATRIOT Act. As expanded, this law prohibits
the possession of "any biological agent, toxin, or delivery system"
without the justification of "prophylactic, protective, bona fide
research, or other peaceful purpose." (See

PATRIOT Act expansion.)

Even under the expanded powers of the USA PATRIOT Act, it is difficult
to understand how anyone could view CAE's art as anything other than a
"peaceful purpose." The equipment seized by the FBI consisted mainly of
CAE's most recent project, a mobile DNA extraction laboratory to test
store-bought food for possible contamination by genetically modified
grains and organisms; such equipment can be found in any university's
basic biology lab and even in many high schools (see "Lab Tour" at
http://www.critical-art.net/biotech/free/ for more details).

The grand jury in the case is scheduled to convene June 15 in Buffalo,
New York. Here, the jury will decide whether or not to indict Steve
Kurtz on the charges brought by the FBI. A protest is being planned at
9 a.m. on June 15 outside the courthouse at 138 Delaware Ave. in
Buffalo.

BACKGROUND

Early morning of May 11, Steve Kurtz awoke to find his wife, Hope,
dead of a cardiac arrest. Kurtz called 911. The police arrived and,
after stumbling across test tubes and petri dishes Kurtz was using
in a current artwork, called in the Joint Terrorism Task Force.

Soon agents from the Task Force and FBI detained Kurtz, cordoned off
the entire block around his house, and later impounded Kurtz's
computers, manuscripts, books, equipment, and even his wife's body for
further analysis. The Buffalo Health Department condemned the house as
a health risk.

Only after the Commissioner of Public Health for New York State had
tested samples from the home and announced there was no public safety
threat was Kurtz able to return home and recover his wife's body. Yet
the FBI would not release the impounded materials, which included
artwork for an upcoming exhibition at the Massachusetts Museum of
Contemporary Art.

While most observers assumed the Task Force would realize that its
initial investigation of Steve Kurtz was a terrible mistake, the
subpoenas indicate that the feds have instead chosen to press their
"case" against Kurtz and possibly others.

N.E.S.T - Network Examination of Serendipitous Transfer.

Online 'chinese whispers', best describes c6's latest work. The software is
free! When installed, it logs you in to a community deeply involved in the
act of corruption..Data corruption that is! When online the program links to
its nearest geographical neighbours to form a ring of users. As an audio
file is passed, those connected look and listen for signs of change and who
knows? Perhaps even serendipity!

The passing audio file is visualised within the conventional application
window, with statistics on cycle involvement and neighbours details
displayed below. The bottom half of the screen shows you, the state that the
file is in, its packets mapped to a rising cubic terrain in both 2D and 3D.

A world map (on the website) shows the NEST poulation rising and falling as
users log on and off. The nationalities locations and stats gives the up to
date state of international corruption.

C6 co-create with those of lesser connections. Turning the frustration,
dropped and erratic data transfer experienced, into a medium for collective
artistic involvement. Each user can snapshot their findings and add to a
growing database of weird sounds and strange terrains.

This SETI inspired art work is the first of three planned software releases
from c6 in the future. The first, NEST searches virtual space for corruption
and chaos, a far cry from its inspiration's distributed analysis of deep
space chaos for intelligence.

Photographer Seeks Subjects

I am looking for multi-generational, multi-ethnic Queens New York residents
for portraits / interviews.

The Wild Posting Project consists of designing and hanging a series of
portrait style snipe posters with accompanying quotations from the people
that live in these Queens communities. Each subject is a representation of
the diversity of the larger Queens population. 300 posters will be hung at
25 locations throughout Queens. The portraits, which use the traditional
advertising techniques of immersion and frequency, promote the faces and
thoughts of people that are in adjacent neighborhoods and reclaims public
space for the community.

As part of the exhibition public.exe: Public Execution, curated by
Michele Thursz and Anne Ellegood, with assistant curator Defne Ayas and
guest sound curator Anthony Huberman, Turkish artist Serkan Ozkaya will
be installing a large-scale work in the windows at Exit Art, entitled
"What an Art Gallery Should Actually Look Like (Large Glass)." For this
piece, Ozkaya needs up to 20,000 35mm slides of art works and/or
exhibition installation shots.


Opening on June 12th, public.exe explores how artists are rearticulating
the definition, distribution, and reception of public art. Proposing new
possibilities for the genre of public art inspired by the uses of new
technologies and their impact on cultural production and social systems,
the works in the exhibition will exist outside the conventional white
cube gallery space.

Ozkaya's work requires the participation of a large public! We would be
grateful if you could contribute any slides you have available to this
piece. The work will be an amazing collection of donated images that
will create a mosaic on the large windows along 36th Street at Exit Art.


Because the piece requires contributions from such a large number of
people, we will not be able to return slides. Large contributions from
anyone who is cleaning out their archives is greatly appreciated!

POSITION DESCRIPTION
Responsible for lecture, laboratory instruction, and curriculum development
in all phases of photography including digital photography. This assignment
also involves coordinating both the staff and facilities, and shall include
the ordering and overseeing of the photography supplies necessary for the
lab experience.

QUALIFICATIONS
Academic: Bachelor's degree and two years of professional experience; OR
Associate's degree and six years of professional experience; OR the
Equivalent. (Professional experience shall be full-time in an environment
applying the skills required of this position; Degree[s] must be from an
accredited institution.)
Experience: A minimum of two years of teaching experience in digital
photography. Strong academic and professional background with teaching
experience in both digital and traditional photography; including
photojournalism, studio portraiture, Photoshop, lighting techniques, and
color photography. Must be able to demonstrate the ability to teach both
introductory and advanced digital and traditional photography effectively.
Must have strong interpersonal skills and be able to communicate with
colleagues and students.
Other: Evidence of a sensitivity to and understanding of the diverse
academic, socioeconomic, cultural, disability, and ethnic backgrounds of
community college students (E.C. 87360a).

CONDITIONS OF EMPLOYMENT
1.Ten-month, tenure-track position.
2.Salary is commensurate with academic preparation, full-time teaching or
equivalent experience with a range from Column C, Step 1 to Column H, Step
6 ($43,384 to $66,842) of the current Faculty Salary Schedule effective
June 17, 2002.
3.Medical and dental benefits are provided for the employee and dependents. 
4.A $50,000 life insurance policy is provided for the employee.
5.Orientation to the college is required as is adherence to college
Improvement of Instruction Policy.

laboratory safety procedures; coordinating the class schedule to optimize
class rotation for student participation, this will include a two-year
class rotations for students wishing to graduate; coordinating and
organizing the staff, including developing the teaching assignments each
semester; performing and implementing the program review process, including
updating the course outlines and textbooks as necessary; planning for
future development of the program through annual advisory meetings with the
industry partners; effectively interfacing with the other members of the
Applied Technology Department; develop curriculum in photography that
includes the integration of a wide variety of multimedia applications using
web design and digital.
3.Assignments are based upon the assumption of workload of forty hours
weekly, including but not limited to conducting classes, class preparation,
office hours, student evaluation, committee work, curriculum and program
development, and student activities.
4.Other responsibilities include maintaining standards of professional
conduct and ethics appropriate to the professional position.
5.Supervising student organizations and other co-curricular activities
and/or District committee work is expected of all faculty members.

I am writing to initiate an unconventional residency program at my home in
Los Angeles. My interest is in project oriented collaboration, the laws of
which will be determined by the resident and myself in question upon our

middle of the block in Koreatown. My bright fresh house is in the east,
between many things, and not close to the ocean. As for the details. I will
